Welcome to MenuTune! These Terms and Conditions ("Terms") govern your use of the MenuTune website, mobile applications, and services (collectively, the "Service") operated by MenuTune Inc. ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

MenuTune provides a platform that enables restaurants to create digital menus, websites, and QR code-based menu systems. Our services include:

• Digital menu creation and management tools
• Restaurant website building and hosting
• QR code generation for contactless menu access
• Theme customization and design tools
• Analytics and reporting features
• Customer support and technical assistance

To use certain features of our Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you meet this age requirement.

MenuTune offers both free and paid subscription plans:

Free Plan

• Limited features as outlined on our pricing page
• No monthly fees
• Subject to usage limitations

Paid Plans

• Monthly or annual billing cycles
• Automatic renewal unless cancelled
• Payment due at the beginning of each billing period
• Access to premium features and support

By subscribing to a paid plan, you authorize us to charge your payment method for the subscription fee at the beginning of each billing period until you cancel your subscription.

You retain ownership of all content you upload or create using our Service ("User Content"), including menu items, descriptions, images, and restaurant information.

License to Use Your Content

By uploading User Content, you grant MenuTune a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing our services to you.

Content Restrictions

You agree not to upload or create content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains false or misleading information
• Is offensive, harmful, or inappropriate
• Contains malicious code or viruses

You may not use our Service:

• For any unlawful purpose or to solicit unlawful acts
• To violate any international, federal, provincial, or state regulations or laws
• To transmit or procure sending of advertising or promotional material
• To impersonate or attempt to impersonate the company, employees, or other users
• To upload or transmit viruses or malicious code
• To interfere with or circumvent security features
• To reverse engineer or attempt to extract source code

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We may experience downtime due to:

• Scheduled maintenance
• Technical difficulties
• Third-party service interruptions
• Force majeure events

We reserve the right to modify, suspend, or discontinue any part of our Service with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

Termination by You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Termination by Us

We may terminate or suspend your account immediately if you breach these Terms, without prior notice or liability. Upon termination, your right to use the Service will cease immediately.

Data Retention

After termination, we will retain your data for 30 days to allow for reactivation. After 30 days, your data may be permanently deleted. You may request data export before termination.

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

MenuTune disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In no event shall MenuTune be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or use, incurred by you or any third party.

These Terms shall be interpreted and enforced in accordance with the laws of Delaware, United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Delaware.

We reserve the right to update these Terms at any time. When we do, we will post the updated Terms on this page and update the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
